There are a number of intellectual property rights which exist in our websites and other platforms. Any logos or branding are protected by registered trade mark rights or the law of passing off. There are also database rights in the databases underlying our websites and connected platforms. However, most of our website, including the text, design, graphics, data, website layout and any music, broadcasts, software and images on the website, are protected by copyright.
The interconnected operations and functioning model of the entire platform is pantented by a secondary licensing company which holds majorty of our intellectual properties. including patents of business model, process patents of functioning and operations of the entire platform with connections and utilization of other platforms and services based on the internet.
Accordingly, agreements in advance are made that the copyright or any other forms of intellctual properties in anything created by the contractor for ours will be owned by us, so that we are able to do what we want with it. Organizations might have paid someone or some other group/organization to produce or create something on our behalf – if we are granted a licence to use the elements or required content, this does not necessarily mean that they can use the provided contents or elements in their operations as well. As such actions will be directly treated and considered infringements of license or rights given by the context of the scenario.
Intellectual Property rights in something is infringed if it is reproduced in any material form. Therefore, a person can risk infringing copyright if they reproduce someone else's elements or contents for their use in any form without permission. Similarly, a copyright might be infringed if someone else reproduces materials, contents or elements on their work without permission.
Whether copyright has been infringed also depends on what has been reproduced. If a work has been copied completely and the infringer cannot prove that he has created the work independently of the copyright work, then infringement will be easy to prove.
Framing allows a website to be displayed in a smaller window on another website. It is feasible that if someone frames a website without the consent of the website owner then that person may be liable for copyright infringement by publishing the work. A person can play safe by seeking permission from the owner of another site.
Software is protected by copyright and a combination patents of different parts of the entire platform. However, provided the platform and it's operations are new, involves multiple inventive steps, is capable of industrial application and has a technical effect, it is under patent protection. The US permits patents for both software and business methods.
